Terms - Civic Quiz France (CQF)

1. Publisher Identity & Contractual Scope
These Terms and Conditions of Use and Sale (hereinafter “Terms” or “CGUV”) constitute a legally binding agreement between MTech France (hereinafter “the Publisher”, “we”, or “us”) and any individual user (hereinafter “User” or “You”) who downloads, installs, accesses, or purchases digital in-app content within the mobile application “Civic Quiz France” (hereinafter “the Application” or “CQF”).
The Application is officially distributed under the brand JOYAPP on the Apple App Store (for iOS/iPadOS devices) and under the brand BlackCube technologies on the Google Play Store (for Android devices).
2. Contractual Definitions
- User / You: Any individual accessing or purchasing services within the Application.
- Consumer: Any natural person acting for purposes outside their trade, business, craft, or profession.
- Digital Content / Digital Service: Question databases, mock exams, mnemonic notes, summaries, translations, and pedagogical tools provided in the Application.
- Lifetime Access: Digital software license unlocked for the commercial lifecycle of the Application after a one-time single fee.
- Subscription: Recurring periodic billing model (e.g., monthly subscription) unlocking premium access for active subscription periods.
- Third-Party Platform Providers: Apple Inc. (App Store, StoreKit) and Google LLC (Google Play Store, Google Play Billing).
3. Acceptance of Terms & Minors
Downloading, installing, or using the Application constitutes full and unreserved acceptance of these Terms. If you do not agree to these Terms, you must uninstall the Application immediately. Minors must use the Application under the supervision of a legal guardian.
4. Independent Non-Official Status & No Exam Guarantee Disclaimer
Crucial Legal Disclaimers:
Private Independent App: The Application is an independent private educational study aid. It is not affiliated with, endorsed by, or representing the French Government, the Ministry of the Interior, the OFII, or any prefecture.
No Guarantee of Success: The Publisher does not guarantee passing the official French civic exam, nor the issuance of a residence permit (CSP / CR) or French citizenship. Users remain exclusively responsible for their own study and administrative filings.
5. Question Bank Origin & Community Candidate Recollections
- Questions labeled as “real questions” or “exam feedback” originate exclusively from voluntary candidate testimonials shared on public forums.
- They are simulated approximations for educational practice. The Publisher does not warrant that official exam questions will be identical in wording or choices.
6. Local-First Architecture & Data Loss Disclaimer
Total Disclaimer on Local Data Loss:
The Application operates on a 100% local architecture without user accounts. All progression data, quiz scores, and error logs are stored exclusively in your device's local memory.
If you uninstall the app, clear storage in settings, reset your device, or switch devices without a complete OS backup, all local progress will be permanently erased. Technical recovery is impossible, and the Publisher is fully disclaimed from any liability.
7. Technical Requirements, Compatibility & Availability
The Application requires a compatible iOS or Android device with an up-to-date operating system. The Publisher deploys best efforts to maintain service availability, subject to routine maintenance or store platform outages.
8. Store Account Binding, Non-Consumable Restores & Apple Family Sharing
- Purchases are tied to your Apple ID or Google Account.
- Non-consumable purchases (e.g., Lifetime Access) can be restored at any time on new devices signed into the same store account using the “Restore Purchases” button.
- Apple Family Sharing is supported where applicable under standard Apple policies.
9. Pricing, In-App Purchases, Right of Withdrawal & Price Adjustment Rights
- Reference pricing: Monthly subscription at €4.99 / month and Lifetime access on the Apple App Store at €14.99 (one-time purchase), with equivalent tiers on Google Play.
- No price parity guarantee: Due to regional taxes (VAT), exchange rate variations, and platform fee structures, strict cross-store price parity is not guaranteed.
- Right to modify prices: The Publisher reserves the right to modify prices for future subscriptions and lifetime purchases at any time without retroactive effects on previously acquired lifetime rights.
- Immediate execution & waiver of 14-day withdrawal: In accordance with consumer law (e.g., French Consumer Code Art. L. 221-28 13°), digital content supplied immediately upon purchase waives the statutory 14-day cooling-off period once execution has begun with user agreement.
- Refunds: Managed directly through official Apple or Google customer support channels.
10. Question Bank Updates & Progress Recalculations
The Publisher updates the question bank periodically to reflect official decrees. Without cloud sync, major syllabus overhauls may cause local statistics or percentages to recalculate. The Publisher uses best efforts to minimize technical disruption.
11. Intellectual Property & Commercial Database Protection
The UI/UX, pedagogical flow, software code, revision algorithms, mnemonic notes, and commercial question bank are protected by copyright and the sui generis right of database producers (Article L. 341-1 et seq. of the French Intellectual Property Code).
Automated scraping, copying, reverse engineering, decompilation, resale, mirroring, or feeding third-party AI models is strictly prohibited and subject to legal prosecution.
12. Prohibited Conduct & Security Rules
Users agree not to bypass security controls, use automated scraping tools, or reverse-engineer the Application. Violations will result in immediate service termination and legal claims.
13. Limitation of Liability & Force Majeure
The Publisher is not liable for indirect damages, loss of chance, or exam registration costs. Force majeure events (telecom breakdowns, cloud outages) release the Publisher from performance obligations.
14. Governing Law & Contact
