This clause applies to all versions, features, and digital content of “Civic Quiz Fr” (CQF) available on the App Store and Google Play Store.
. Developer identity and scope
1.1 Service provider
The application is provided and operated by the developer displayed on the app's store page (hereinafter the “Developer” or “we”). The public information shown on that page shall prevail.
1.2 Scope
These GTUS constitute:
- the General Terms of Use (GTU) defining the rules for using the app; and
- the General Terms of Sale (GTS) governing the transfer of paid digital content/services.
They form a contractual set together with the Privacy Policy and the Legal Notice. In the event of conflict, the interpretation most favorable to the user’s mandatory statutory rights shall prevail.

2. Definitions
- User / You: any natural person who downloads or uses the app;
- Consumer: a user acting for non-professional purposes (within the meaning of French/EU consumer law);
- Digital content / digital service: question bank, explanations, learning features, documents displayed within the app (subject to the French Consumer Code rules on contracts for digital content/services);
- Lifetime (lifetime access): right of use unlocked after a one-time payment (see Article 7);
- Subscription: periodic and/or auto-renewing paid model currently available (see Article 9);
- Third-party providers: Apple App Store, Google Play Store, Apple In-App Purchase, Google Play Billing, and any order/receipt management service (e.g., RevenueCat).

3. Acceptance of the terms
3.1
Downloading, installing, accessing, or using the app constitutes full and unconditional acceptance of these terms. If you do not agree, stop using and uninstall the app immediately.

Minors must use the app with the consent and under the supervision of their legal representative.

4. Service content and non-official statement
4.1 Service content
The app offers exercises, a question bank, explanations, educational resources, and learning aids related to the French civic exam (as actually offered within the app).
4.2 Non-official statement
CQF is an independent preparation tool and is not affiliated with the French Government, the Ministry of the Interior, or any official authority. Content is provided for informational purposes only and must not be considered official. Official information must be consulted via government channels.

5. Technical conditions, compatibility, and accessibility
5.1 Devices and systems
The app requires a compatible iOS/iPadOS or Android device. Exact configuration requirements depend on the respective store listing. A network connection may be required to download/update the question bank, access links, or verify purchase status.
5.2 Service availability
We make reasonable efforts to keep the app available, but do not guarantee continuous availability or error-free operation. Interruptions related to system updates, platform rules, third-party services, or force majeure will be remedied where possible.

6. Accounts, devices, and restoring purchases
6.1
Rights linked to purchases are attached to the same Apple ID or Google Account. You can restore your purchases on your own devices connected to the same account (subject to Apple/Google system capabilities).

In case of device change or reinstallation, use the “Restore Purchases” function if available, or report an issue via the app.

7. Price, payment, delivery, and refunds (Lifetime and monthly subscription)
7.1 Price display
For version v1.2 (effective April 2, 2026), reference prices are EUR 4.99/month for the monthly subscription and EUR 12.99 for the Lifetime one-time purchase. Actual billed prices are those shown on the store checkout page and may vary by taxes, region, currency, and platform rules.
7.2 Payment and transactional entity
All transactions are processed via Apple App Store / Apple In-App Purchase or Google Play Store / Google Play Billing. We do not have access to your banking details or password.
7.3 Digital delivery
Once payment is validated, the corresponding content or rights are unlocked immediately (service performed immediately).
7.4 Refunds
Refund policy is managed by the respective platform (Apple or Google). For any request, use official platform channels and follow their decision.
7.5 Right of withdrawal (EU/France)
For distance sales, consumers generally have a 14-day withdrawal period. However, for digital content not supplied on a tangible medium, where you explicitly agree to immediate performance and waive this right, an exception applies. The applicable conditions and evidence fall under the store's purchase procedure (Apple/Google); in case of dispute, the rules applicable to the transaction shall prevail.
7.6 Local Storage and Data Protection (GDPR)
In compliance with the General Data Protection Regulation (GDPR), all learning progress, settings, and history are stored exclusively on the user's local device. Consequently, the developer cannot recover data if the app is uninstalled or if data is cleared by the user. No refund claims will be accepted for data loss resulting from user actions.
7.7 Service Continuity and Liability Limits
(a) Exclusion for Force Majeure and Third-Party Platforms: The developer is not liable for the inability to restore purchases due to force majeure or failures of key third-party infrastructure (Apple App Store, Google Play, RevenueCat, etc.). No refunds will be granted in such cases.
(b) Internal Software Bugs: Notwithstanding the above, if a restoration failure is the direct result of a bug within the application following an update, the developer will provide restoration assistance or commercial solutions in accordance with the legal warranty of conformity.

8. Scope of updates, frequency, and limitations
8.1 Scope of promised updates
After purchasing Lifetime, guaranteed developments relate only to the question bank (adding questions, corrections, improving explanations, adjustments in line with official curricula, etc.).
8.2 Frequency and timeline decided by the Developer
Update schedule and pace depend on product planning, available resources, and regulatory requirements. No fixed frequency or specific deadline is promised.
8.3 Educational content and partners
Documents (PDFs, links) or content provided by partners may be modified, replaced, or removed for contractual, rights-related, or compliance reasons. Such adjustments do not constitute a contractual delivery obligation; continuous availability is not guaranteed.
8.4 Major changes in policies or the exam
When a substantial change in the official framework occurs (policies, format, assessment criteria, curricula, or procedures), a temporary gap may appear. We will make reasonable efforts to update content, without promising a specific timeframe or guaranteeing learning or exam outcomes, subject to mandatory legal rights.
8.5 Statutory update obligations (conformity)
Certain French/EU rules require providing updates necessary to maintain conformity. If you refuse or delay installation of essential updates despite clear notice from us, we may not be liable for consequences of such non-conformity.

9. Active subscription model and acquired rights
9.1 Current offer
As of version v1.2 (effective April 2, 2026), the app offers:
- a monthly subscription with a reference price of EUR 4.99/month;
- a Lifetime one-time purchase with a reference price of EUR 12.99.
Actual billed prices may vary by country/region, currency, taxes, and platform rules (App Store / Google Play).
9.2 Protection of previously purchased Lifetime rights
Users who purchased Lifetime before the price revision keep their lifetime access within the scope already acquired. No retroactive surcharge applies to those acquired rights.
9.3 Apple Family Sharing (iOS)
The monthly subscription supports Apple Family Sharing when this option is enabled and eligible in App Store Connect. Actual availability depends on Apple rules (account, country/region, household eligibility) and may change.
9.4 Subscription operations
All subscription operations (purchase, renewal, cancellation, refund, free trial) are managed by the relevant platform (Apple App Store or Google Play Store) under its rules.

10. Legal warranty of conformity (France/EU)
10.1 Obligations and duration
Under the French Consumer Code, professionals must provide digital content/services that conform to the contract; for a one-off supply, liability applies for two years from delivery where a lack of conformity is found (according to applicable statutory text and case law).
10.2 Remedies
In the event of non-conformity, the consumer may require conformity within a reasonable time and at no cost; in certain situations, a price reduction or contract termination may be requested (subject to statutory conditions).

11. Display of partners/advertising (if applicable)
The app may display partners or sponsored content. Such displays are purely informational and do not constitute a recommendation, warranty, or commitment toward these third parties. Any dispute arising from interaction between a user and a partner must be settled directly between them.

12. Usage rules and prohibited conduct
Prohibited conduct (non-exhaustive list):
- Copying, extracting, using bots, or creating mirror apps, question-bank APIs, or redistribution products;
- Reverse engineering, unpacking, injecting, or bypassing access/payment protections;
- Using the app for unlawful purposes or infringing third-party rights;
- Disrupting operation or attacking third-party services (including Apple).
In case of serious breach, we may restrict access, suspend services, or take legal action. We reserve the right to seek compensation for damages, including attorney fees, revenue losses, claims, etc.

13. Intellectual property and third-party content
13.1 Our rights
The UI, code, translations, original analyses, and content organization are protected by copyright; the structure of the question bank may also benefit from sui generis database rights. Any unauthorized reproduction or extraction is prohibited.
13.2 Open official information
We reference only officially published information accessible to the public (curricula, examples, public pages) and indicate the source and date where applicable; we do not claim use of Etalab / Licence Ouverte datasets.
13.3 Third-party content (PDFs, links)
These documents belong to their authors. If permissions change or content is withdrawn, we may replace or remove such content without guaranteeing continuous availability.
13.4 Notice of infringement
For any dispute, write to yiconsei@orange.fr with proof of rights, the location of the content, and your contact details. We will review and take appropriate measures (correction, deletion, takedown).

14. Limitation of liability (within legal limits)
14.1 No guaranteed result
The app does not guarantee success in an exam or the outcome of an immigration, residence, or naturalization application. You must rely on official information and make decisions knowingly.
14.2 Indirect damages excluded
To the extent permitted by law, we are not liable for indirect damages such as loss of profits, opportunities, or non-material harm.
14.3 Force majeure
In the event of force majeure (major network outage, interruption of Apple/third-party services, public intervention, natural disaster, etc.), we cannot be held liable for delays or failures, in compliance with statutory obligations.
Certain limitations are excluded by French/EU law when they concern consumers: they apply only to the extent permitted.

15. Amendments to the terms
We may update these terms for legal reasons or product changes. Material changes will be published in the app with their effective date; continued use constitutes acceptance, unless the law requires obtaining renewed consent.

16. Governing law and disputes
16.1 Governing law
French law applies in principle. If you are an EU consumer, you retain the rights granted by mandatory rules of your country of residence.
16.2 Dispute resolution
In the event of a dispute, first attempt an amicable resolution via yiconseil@orange.fr. Failing that, the competent courts of your place of residence shall have jurisdiction.
